Terms of Use

1. Agreement

By downloading, accessing, creating an account for, or using Chalk Arcade, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Chalk Arcade. “Chalk Arcade,” “we,” “us,” and “our” mean the Chalk Arcade developer identified on the Apple App Store or Google Play listing from which you obtained the app.

The storefront's terms also apply. On Apple devices, the licence is additionally subject to Apple's Standard Licensed Application End User License Agreement unless App Store Connect states that a custom EULA applies. If these Terms conflict with mandatory storefront terms, the mandatory storefront terms control to that extent.

2. Eligibility

Chalk Arcade is intended only for people aged 13 and older and is not directed to children under 13. You must be at least 13 to use any part of Chalk Arcade, including local Guest Mode.

If the law where you live requires a higher minimum age to agree to these Terms or consent to personal-data processing, that higher age applies unless a parent or legal guardian can lawfully provide the required authorisation. Chalk Arcade does not currently offer a child account or parent-managed account process.

3. Limited app licence

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use Chalk Arcade on devices you own or control, for personal, non-commercial entertainment, subject to these Terms and the applicable storefront rules. Chalk Arcade is licensed, not sold.

You must not:

• copy, rent, sell, redistribute, sublicense, or commercially exploit the app or its content except where law expressly allows;
• reverse engineer, decompile, bypass, or tamper with security, access, matchmaking, entitlement, or technical-protection measures except where a non-waivable law permits it;
• use bots, automation, modified clients, exploits, or false data to interfere with online play or service integrity;
• probe, overload, attack, scrape, or gain unauthorised access to the service, another account, or non-public systems; or
• remove ownership, trademark, copyright, or attribution notices.

4. Guests and accounts

You can use supported local features as a guest. Local guest progress stays on that device and can be lost if app storage is cleared, the app is uninstalled, or the device is lost. We are not responsible for local guest data that cannot be recovered.

An account may be needed for cloud progress, account recovery, friends, supported online play, or other member features. You agree to give accurate information, protect your password and device, and tell us promptly if you suspect unauthorised use. You are responsible for activity carried out through your account unless applicable law says otherwise. You may not sell, share, or transfer an account.

5. Player identity and conduct

Chalk Arcade assigns each account a stable public player alias and renders its monogram inside the app. The initial release does not let players choose a public display name or upload a public profile image. Account handles and email addresses are private sign-in or exact friend-discovery identifiers and are not displayed to other players.

You must not use Chalk Arcade, its accounts, friend discovery, room codes, or online play to:

• engage in illegal, threatening, hateful, harassing, sexually explicit, exploitative, self-harm-promoting, or violent conduct;
• violate privacy, publicity, intellectual-property, or other rights;
• impersonate another person or misleadingly suggest affiliation;
• distribute malware, spam, advertising, scams, or attempts to collect secrets; or
• reveal passwords, one-time codes, room codes, authentication tokens, or sensitive personal information.

We may restrict discovery or online features, or suspend an account when reasonably necessary to enforce these Terms, protect players, or comply with law. Contact [email protected] to report abuse.

6. Games and online play

Chalk Arcade is for entertainment. Scores, levels, virtual themes, progress, and other in-app status have no cash value and cannot be exchanged for money or property. Chalk Arcade does not offer gambling or cash prizes. Do not use it to organise wagering.

Online matches depend on compatible app versions, connectivity, other players, and service availability. Some matches are client-authoritative and intended for casual, unranked play. Network interruption, another player's departure, or version incompatibility may end a room or prevent a result from being recorded.

Other room members are identified by generated player aliases and local monograms. Public leaderboards are disabled for the initial release; personal records may still be stored and shown on your own device.

7. Purchases and subscriptions, if offered

Chalk Arcade may offer paid products or subscriptions in a future version. The app and storefront will show the price, currency, billing period, included benefits, and renewal terms before purchase. Apple or Google processes payment, renewal, cancellation, and refunds under the rules of the storefront where you bought the product.

If a subscription is offered, it may renew automatically until you cancel it in your Apple or Google account settings within the period stated by the storefront. Deleting Chalk Arcade or deleting a Chalk Arcade account does not itself cancel a storefront subscription. Unless law requires otherwise, virtual access already delivered is not redeemable for cash. Statutory refund and withdrawal rights are not limited by these Terms.

8. Privacy

Our Privacy Policy describes the data involved in accounts, progress, online features, analytics, diagnostics, retention, and deletion. Analytics and crash diagnostics are independent controls and both start on in a fresh mobile install. You can turn either one off in the app's Settings.

9. Ownership and feedback

Chalk Arcade, including its software, game implementations, designs, artwork, text, audio, branding, and service content, is owned by us or our licensors and is protected by intellectual-property laws. These Terms do not transfer ownership to you.

If you voluntarily send ideas or feedback, you allow us to use them without restriction or payment, while we will continue to handle any personal data in the feedback under the Privacy Policy. Do not send confidential material or content you do not have permission to share.

10. Third-party services

Chalk Arcade relies on services such as Apple App Store, Google Play, Supabase, and optional Firebase features. Their products and accounts may be governed by separate terms and privacy policies. We are not responsible for an independent third-party service, but we remain responsible for our own obligations and our selection and use of processors as required by law.

11. Updates and availability

We may add, change, balance, pause, or remove games, levels, themes, online features, and service content; release compatibility or safety may require an app update. We aim to keep Chalk Arcade available but do not promise uninterrupted, error-free, or permanent availability. Maintenance, outages, platform changes, security needs, or events beyond reasonable control may interrupt the service.

12. Suspension, termination, and deletion

You may stop using Chalk Arcade at any time. Account holders can permanently delete their account in Settings or use our outside-app deletion path. Storefront subscriptions, if any, must be cancelled separately.

We may suspend or terminate access when reasonably necessary for a serious or repeated breach, security or abuse risk, legal requirement, or discontinuation of the service. Where appropriate and lawful, we will give notice and a chance to appeal. Sections intended by their nature to survive—such as ownership, disclaimers, liability, and dispute terms—continue after termination.

13. Disclaimers

To the maximum extent allowed by law, Chalk Arcade is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that progress will never be lost, every device will remain compatible, or an online opponent will remain connected.

Nothing in these Terms excludes a warranty, consumer guarantee, or other right that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent allowed by law, we and our suppliers will not be liable for indirect, incidental, special, consequential, or punitive loss, or for loss of profits, opportunity, goodwill, or data, arising from Chalk Arcade. Our aggregate liability arising from the service will not exceed the greater of the amount you paid us for Chalk Arcade in the 12 months before the event or the minimum amount required by applicable law.

These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.

15. Law and disputes

Before filing a claim, please contact us and allow a reasonable chance to resolve it informally. These Terms are governed by the laws of the country in which the Chalk Arcade developer is established, without applying conflict-of-law rules. If you are a consumer, this does not take away mandatory protections or courts available under the law of your usual residence.

16. Changes to these Terms

We may update these Terms to reflect app, legal, safety, or business changes. We will change the date above and provide additional notice when a change is material and notice is required. If you continue to use Chalk Arcade after updated Terms take effect, you accept them to the extent permitted by law. If you do not agree, stop using the app and delete your account.
